Max Miller’s ex-wife, Emily Moreno, has sued the embattled Ohio congressman, alleging that he “recklessly” published a nude photograph of their young daughter. The lawsuit, filed Wednesday, stems from an X livestream Miller hosted on August 2 as he sought to rebut Moreno’s allegations of abuse. After the livestream, the Republican posted a link to a Dropbox folder containing documents he said supported his defense of the accusations. Moreno — who is suing both Miller and his attorney Aaron Minc — claimed that among those documents was a nude image of their toddler “depicting her genitalia.” “Faced with a mostly self-inflicted dumpster fire of public attention to his reputation for abusive behavior, Miller so desperately wanted to salvage his political job, that he recklessly and intentionally provided Minc a trove of documents and photos, indifferent about what they contained or how they were used,” the suit states. Over 400,000 people allegedly interacted with or saw Miller’s posts containing the Dropbox link, and the nude image in the folder purportedly remained online and available to download for roughly 23 hours. Minc apologized for what he described as an oversight in an August 3 email, writing “I am truly sorry and deeply regret the error,” according to the lawsuit. At one point, he also insisted that there was no nude image where genitalia were visible. Moreno is seeking $150,000 in damages for every time the photo of her daughter was downloaded. The Independent has contacted Miller and Minc for comment. Miller, who is running for reelection in Ohio’s 7th Congressional District, has faced calls to drop out amid allegations of domestic abuse levied by Moreno. After the pair divorced last year, Moreno accused Miller of throwing hot water on her, holding a gun to her head, throwing her against a wall and fracturing their 2-year-old daughter’s collarbone. Miller has maintained his ex-wife’s assertions are not true and has claimed she is mentally unstable. Earlier this month, the House Ethics Committee opened an investigation into Miller at his request as part of an effort to clear his name. “I have absolutely nothing to hide,” Miller wrote in an August 4 X post. “We will be providing the committee all necessary documents needed for a [detailed] examination. The accusations continue to change, but my facts stay the same.” President Donald Trump gave Miller his “complete and total” endorsement in May, but earlier this month, he called the embattled congressman to express concern, sources told ABC News. “Maxie, it's going to be a tough race,” Trump told Miller, the congressman recounted to CNN. But Miller remained adamant he will stay in the race, telling the network: “I am never going to give up.” On August 2, Senator Bernie Moreno, an Ohio Republican and the father of Emily Moreno, called on Miller to drop out of the race, describing him as “a danger to my daughter.” The deadline to remove Miller’s name from the Ohio ballot passed on Monday.
