Speaking after a judge declared a mistrial in Clancy's case yesterday (Friday), Patrick Clancy issued a statement through his lawyer, David Meier, saying that "reliving this tragedy through another trial" would be "extraordinarily painful". "Patrick Clancy is grateful to the Court and to the jurors for their hard work, their commitment, and their perseverance," reads Meier's statement, obtained by CBS News. "The loss of Patrick’s children is something from which he will never recover and from which there will never be closure. The prospect of reliving this tragedy through another trial is extraordinarily painful - for Patrick, for his family, and for all of us." Judge William Sullivan officially declared a mistrial in Clancy's case after jurors could not reach a unanimous verdict on whether Clancy is criminally responsible for killing her three children, despite multiple instructions by Sullivan to keep trying. Clancy remains charged with murder and will continue to be held in a psychiatric hospital until the case is resolved. Judge Sullivan has scheduled a hearing for September 29. During the proceeding, her lawyer, Kevin Reddington, is expected to ask the judge to declare Clancy not guilty - a move that is very unlikely to succeed. The prosecution can choose to refile the case and restart the trial with a new jury. However, both sides could also agree to a plea deal to avoid the expense and uncertainty of a second trial. If convicted, Clancy faces life in prison without parole. If she is found not guilty by reason of insanity, she could instead be committed to a state psychiatric hospital.
