Oil prices are lower, the bond market is stable, and yet the major stock averages are having a muted day. That's not what you'd expect, considering oil and bonds have lately been such headwinds for stocks. What gives? Jim Cramer pointed to weak consumer confidence from the Conference Board's monthly survey, concerns about retail, and "all the headlines about AI don't read well." The headlines in question: Portions of Anthropic's leaked initial public offering prospectus warn about AI's risks to humanity, and OpenAI delayed the release of a model due to safety concerns. The S & P Oscillator, our trusted momentum indicator, moved deeper into oversold territory after Monday's market declines. Portfolio director Jeff Marks noted that the Oscillator's prolonged stretch of oversold conditions coincides with the 10-year Treasury yield hitting 5%. Both Jeff and Jim said it'll be tough for the market to mount a sustained advance with stubborn bond yields. 2. Shares of Boeing are bouncing back after falling almost 7% Monday on news that the FAA was delaying certification of the 737 Max 10 due to a flight-control software glitch. That update was disappointing, but seeing buyers step in Tuesday is notable. Analysts at Bank of America said that if the Max 10 is delayed by 9 months, Boeing's free cash flow could be reduced by $750 million during that period. They called it "manageable and frankly relatively immaterial." Nevertheless, Jim said he wants Boeing to be as transparent as possible when issues arise. "Boeing is a heavily scrutinized company. Every time there's an announcement that something is wrong, just put it out," Jim said. "Then we'll realize how complex it is to create safety in planes. And then we'll be starting to think, 'OK, but how's the business?' Right now, nobody is thinking about how the business is." 3. The board of Goldman Sachs has held talks about naming COO and President John Waldron the bank's new CEO as soon as next year, The Wall Street Journal reported late Monday , citing people familiar with the matter. That could result in Waldron taking the reins from CEO David Solomon in late 2027 or early 2028, according to the report. Shares of Goldman dropped about 1% on Tuesday, as investors also digested smart ring maker Oura's decision to delay its IPO ; Goldman is co-leading that deal. Jim said he wasn't fazed by the WSJ report on a CEO transition, noting that boards need to regularly have these discussions as part of their duty. "I discount the story, and I think what matters is the performance [under Solomon], which is extraordinary," he said. Through Monday's close, Goldman shares were up 390% on a total return basis during Solomon's tenure, which began Oct. 1, 2018 , versus a 106% advance for the Invesco KBW Bank ETF . 4.
