Log in An Arkansas school district filed a lawsuit against a teenager who it accidentally sent $12,000 in a payroll mix-up, according to a report. In a lawsuit, filed October 9 in Pulaski County, the North Little Rock School District alleges 19-year-old Adamaris Guereca received $12,755.62 over the course of five payroll deposits from the school district between May 22 and June 23, KARK reported. Guereca, from Springdale about 165 miles away from North Little Rock, does not work for the district as an employee or contractor but still withdrew the deposits that were marked “NLR School Dist PAYROLL,” according to the lawsuit. The teen’s account had no money in it when the first deposit was received, and after the money was withdrawn, the account had a negative balance, the lawsuit claims. The complaint states that the district sent Guereca two letters September 9, one that was certified and one that was not, seeking repayment by September 23. The certified letter was returned to its sender on September 30. The other letter sent through standard mail was not returned, according to the lawsuit. The lawsuit accuses Guereca of conversion and unjust enrichment by acting as the owner of the money, a felony offense, since the amount of money is over $1,000. The district said the money belonged to an employee who had changed their direct deposit information, THV 11 reported. It was not immediately clear whether the teen had any connection to the district, or how the money accidentally ended up in her account. The Independent has contacted North Little Rock School District for more information. The district is asking for a jury trial, the return of the funds, plus pre- and post-judgment interest, attorney’s fees and punitive damages. Guereca has 30 days, or until November 8, to respond to the lawsuit, according to the report.
