A Texas woman is suing a taco chain after finding a cow’s tooth in her to-go order, according to reports.
Nohemi Castillo, who filed her lawsuit on October 13, says that she had purchased a Democrat taco from Torchy’s Tacos in Austin, only to discover the tooth inside. Upon making the discovery, she was left “grossed out and sickened” and eventually decided to visit a doctor that same evening, according to her lawsuit, which was reviewed by Fox 7.
The doctor prescribed Castillo prescription medication on June 9, the day she discovered the tooth. She is now seeking $250,000, her lawsuit states.
Scott Vasquez, Castillo’s lawyer, told KVUE that his client was horrified to see the tooth in her meal.
“Her reaction was disgust. ‘What is this?’” he revealed. “Looking at it, she thought it was a tooth.”
A picture of the tooth was included with Castillo’s lawsuit. In the image, the tooth, slicked in a brown liquid, can be seen next to what appears to be the remains of the woman’s Democrat taco.
A Democrat taco contains beef barbacoa with avocado, cotija cheese, cilantro, diced onions and tomatillo salsa, according to the Torchy’s Tacos website. The item was given its name during a promotion by the company, during which it also offered Republican and Independent tacos.
When Vasquez informed Torchy’s Tacos about Castillo discovering the tooth in her Democrat taco, a manager and lawyer tried to shift the blame for the incident, he told KVUE.
“I thought they’d want to take care of this immediately, and apparently not,” he jabbed. “They just felt, in my view: ‘Let’s blame someone else.’”
In her lawsuit, Castillo has accused Torchy’s Tacos of negligence and of breach of implied warranties, as well as violations of the Deceptive Trade Practices Act and the Food Safety Modernization Act, Fox 7 reports.
The fast food chain told the outlet that it is aware of the incident and confirmed that the object found in Castillo’s meal was, in fact, a cow tooth.
“We source the highest quality food available, which means our barbacoa comes from natural beef cheek that we source from a supplier,” a spokesperson said in a statement. “Upon receiving the guest complaint, we conducted a thorough review and identified the item as a cow tooth.”
“This can occasionally happen when processing the meat, though it is quite rare,” the spokesperson added. “We have partnered with our supplier to reinforce their internal procedures to prevent this from happening in the future.”
However, Vasquez says that the tooth should not have made it all the way through the production process into someone’s meal.
“Someone should have caught it somewhere throughout the process,” he told KVUE. “Should not have even made it to the packaging or the packaged goods that they had.”
Vasquez added, “It could choke somebody. It really could.”
